Pennsylvania's ban on same-sex marriage has been ruled unconstitutional by federal Judge John E. Jones, who said it is now time to toss such laws "into the ash heap of history". This opens the door for gay and lesbian married couples to get an uncontested Pennsylvania divorce. While the Commonwealth of Pennsylvania may still appeal the decision, this is big news for those married but separated couples who reside in Pennsylvania, since until now such couples been unable to qualify for a Pennsylvania divorce. This is because in order for a divorce to be granted by a Pennsylvania court, there must first have been a marriage. Since Pennsylvania took the stance that there was no such thing as a same-sex, gay, or lesbian marriage, then there could also be no Pennsylvania divorce.

Judge Jones made a very clear indication that same-sex, lesbian, and gay marriages are here to stay, by saying that the doctrine of "separate but equal" had finally given way. Judge Jones said that " 'Separate' has thankfully faded into history and only 'equal' remains." He went on to say that the term "same-sex marriage" will be abandoned in favor of "marriage" someday. "We are a better people than what these laws represent," Jones wrote. "It is time to discard them into the ash heap of history."
